Article 1 — Purpose These GTCs govern sales made on nemivia.com between the publisher ("the Seller") and any person making a purchase ("the Customer"). Any order implies unreserved acceptance of these GTCs.
Article 2 — Products Nemivia offers a selection of items for home, well-being, and daily life. Photographs and descriptions are provided for informational purposes only; slight variations in packaging or appearance are possible. Products are offered while stocks last.
Article 3 — Prices Prices are indicated in $, all taxes included, excluding delivery costs specified before order confirmation. The Seller reserves the right to modify its prices at any time; the product is invoiced at the rate in effect at the time of the order.
Article 4 — Order The Customer confirms their order after checking the details of their cart. The sale is confirmed by sending a summary e-mail. The Seller reserves the right to refuse or cancel any order in the event of a dispute, suspected fraud, or obvious pricing error.
Article 5 — Payment Payment is made at the time of order using the methods offered on the site (credit card, and subject to availability PayPal, Apple Pay, Google Pay). Transactions are secure and encrypted; the Seller never has access to the Customer's banking data.
Article 6 — Delivery The terms and delivery times are detailed in the Delivery Policy. Delivery times are given as an indication. In case of abnormal delay, the Customer can contact the Seller at contact@nemivia.com.
Article 7 — Right of withdrawal In accordance with articles L.221-18 and following of the Consumer Code, the Customer has 14 days from receipt to exercise their right of withdrawal, without having to justify it. The terms are detailed in the Returns and Refund Policy.
Article 7.1 — Money-back guarantee Beyond the legal 14-day right of withdrawal, at Nemivia, you have a "money-back guarantee" for 30 days after receipt to change your mind, without justification. Inform us by e-mail at contact@nemivia.com; we will provide you with the return procedure.
Article 7.2 — Return costs Return costs are the responsibility of the Customer, except in the case of a defective, damaged, or non-conforming product, in which case they are fully covered by Nemivia.
Article 8 — Warranties Products benefit from legal conformity warranties (articles L.217-3 et seq. of the Consumer Code) and against hidden defects (articles 1641 et seq. of the Civil Code). In the event of a non-conforming or defective product, the Seller will replace or refund it free of charge to the Customer.
Article 9 — Liability The Seller's liability cannot be engaged for indirect damages resulting from the use of the site or products. Products must be used in accordance with their intended purpose and the instructions provided.
Article 10 — Personal Data Data processing is described in the Privacy Policy.
Article 11 — Disputes and applicable law These GTCs are subject to French law. In the event of a dispute, an amicable solution will be sought first. Failing this, the Customer can use the European dispute resolution platform free of charge (ec.europa.eu/consumers/odr).
